It will be interesting to know what the outcome is. It appears individuals cases in the tribunals do not get satisfactory results, nor cases in the local court. A much better approach as discussed, is if a case can go to a higher court with all our backing. If that wins, the flow on will be for all.
The Federal Court action between Hadenuff and EFS has been settled out of Court.
Even if he had won, EFS would have appealed the judgement which would have dragged everything out and cost a considerable amount more in legal costs.
Everyone reading this thread has been stung, and some have been stung badly. A lot of you are still continuing to pay the extortion, and each day, more and more victims are being stung.
Until you register your details with me, there is a lot of info you are missing out on. If you decide to go one on one with the Finance Company it will cost you a fortune, and you will probably lose.
We need everyone to register your details with me so we can join together and fight as a group. Until this happens, everyone will be picked off one by one.
The details I need are your company name, suburb, contact phone number, email address, person to speak to, which telco/finance company, whether you have a copy of your original contract you signed, whether it is different to the copy the finance company has, where you are up to - ie still paying/stopped paying/legal action, etc. Also, give me a brief outline of your story.
I will put this in my data base and email you as more info comes to my attention.

You don't have to fight this alone, and we are victims as well.
There are thousands of victims out there, and we need you to register with us so that we can put you in touch with other victims of the same finance company, and then organise a united fight against them.
Don't sit on the sideline and think someone else will win the fight for you, you have to help, or you will be fighting by yourself against the finance company.

Clear Telecoms have sent us a letter this morning stating they are going to cut off the phones as of the 20/10/09. We are a small business and I need not go on with the rest as it is all listed in the blog previously.

We were only given a copy of the Order No 1967 and were told we would get a copy of the contract that day or the next - it never arrived - had it done so we would have not proceeded with the contract - when we finally got a copy of the contract some 3 months later it appears we had signed a number of different contracts and everything was photocopied - not sure whether we signed them or not - just remember signing the Order and the authority for Quikfund to take the money out though at that stage we did not know they were a differnt company.
We are having a Group Meeting on Saturday 21st November in Sydney. There will be quite a few legal teams (experienced in our situation) addressing the meeting and offering advice. We are hoping to get a representative from the ACCC to attend and update us on their progress.
Cost: $40 each which covers morning tea, lunch and afternoon tea.
All victims are welcome !!! (no Finance Company spies !!!)

Been a while since my last posting. Have been working with Thunder behind the scenes. Loftygal I agree with your last posting. If we all get behind one strong case, we can all benefit. Will be attending the November meeting and our law firm will be speaking to advise where we are up to with the Federal Court case and explaining why we are using S73 of the TPA in our case. It is important to attend the November meeting to get an understanding of your options. The website is up and running and we should all visit it and if you havn't registered your details with Greg use the website to register or contact us. Uniting our efforts is the only way to fight the finance companies and the scams. Please don't sit on the fence waiting to see what happens; BE INVOLVED AND BE COUNTED IN A UNITED EFFORT AND ATTEND THE MEETING.
