Can anyone tell me what the situation is if someone is fined a lot of money - $150,000 plus - how that fine must be paid, ie, all at once, over time in regular payments, some other way? Thanks.

The date of payment is usually set unless a time to pay option is given. You need to ask a court official what applies in your case. They may refer you to some other agency, depending on the details in your case.

Ok, thanks MartinO. The case hasn't yet gone to court, just looking into the worse case scenario... If you don't mind, I have more questions re your response:

The date of payment that is usually set is usually how long?
What circumstances would usually apply to setting a time to pay option?
And when you say they may refer us to some other agency, depending on the details in the case, what (generally) would that involve?

If it hasn't yet gone to court you can ask for time to pay at the trial, a request to pay it off over 6 months would not be unreasonable. But you need to consider your circumstances and plan ahead on how you may meet the payments, the last thing you want is to be hauled into court for non payment.

What is it that you have actually done? its not often that fines as large as that are imposed, or are you just going by the maximum fine payable for that conviction?

It's nothing I've done Jewlesy, it's a very close friend, and I'd prefer not to go into the details, sorry.

A court wil generally allow time to make payments of that nature.

If for example you need to sell assets that may take some time to realise then the court will allow a reasonable time if there is no other option of payment.
Luke 11 46: Woe unto you also, ye lawyers! For you load men with burdens that are difficult to carry, and you yourselves won't even lift one finger to help carry those burdens.

The first thing you have to establish about any "fine" and you have to do this in Australia now due to the many so-called private contractors who are ILLEGALY fining people.......is whether this fine is LEGAL
I do not want any info....however I must ask this question: were these fines imposed by a government authority (e.g. local council,state/federalgovernment department)....or a private concern ? If its the latter DO NOT PAY as you have review rights at the Consumer Tribunal in your state

Thanks rambler, that's what I thought would happen. After all, who has that kind of money?
And thanks also leagle. Unfortunately it is a government department and it is (ha!) legal.
